Lawsuit Filed Over Mitsubishi Rollover Accident

The parents of a New Hampshire teen who was killed in an SUV rollover accident have filed a lawsuit against Mitsubishi Motors.

Charles and Michelle Foster have filed a lawsuit against Mitsubishi Motors North America, which claims a vehicle design defect is to blame for their 17 year-old son Jason’s death. Jason Alan Foster was one of two people killed in a rollover accident on August 6, 2009. Foster and a 16 year-old girl were riding in the back of a Mitsubishi Montero SUV when the driver lost control and rolled over on a curve in Revere, New Hampshire. Foster and the girl were ejected from the vehicle and killed.

The lawsuit claims the design of the Montero is “unreasonably dangerous.” Attorney for the Fosters, Joseph Balliro Jr., says the Mitsubishi SUV is “notorious” for rollover crashes.

A number of lawsuits have been filed across the country against Mitsubishi alleging that the Montero is top-heavy, making it more likely to rollover. Juries have awarded judgements of more than $11 million in other rollover lawsuits.
